Terms and Conditions for Users

1. Acceptance of Terms

By using the Thaman application, the user acknowledges that they have read, understood, and agreed to these Terms and Conditions in full. Continued use of the application constitutes explicit acceptance of all provisions contained herein.

2. Service Description

Thaman provides an electronic platform that enables users to request valuations of used products and properties, including vehicles, real estate, and other assets. The valuation process is conducted using modern technologies based on scientific, logical, professional, and academic standards designed to estimate the fair market value of used assets.

The service is provided through the selection of a valuation package and payment of the applicable service fees, after which a valuation report is generated.

The user acknowledges that the service provided is an estimated and advisory valuation service only and does not guarantee the actual selling or purchasing price of any asset. The valuation report is not considered an official document or legally binding appraisal, but rather a tool intended to assist in estimating the fair market value of an asset.

3. User Obligations

The user agrees to:

Provide accurate, complete, and up-to-date information, as the valuation process primarily depends on the information supplied by the user.

Upload images and supporting documents related to the asset being valued in a lawful manner.

Ensure that they own or have the legal right to use and submit all uploaded information, images, and documents.

Refrain from providing false, misleading, fraudulent, or forged information or documents.

Use the application only for lawful purposes and in compliance with the laws and regulations of the Kingdom of Saudi Arabia.

Maintain the confidentiality of their account credentials and password and not share them with any third party.

The user bears full responsibility for all information, documents, and data submitted through the application.

4. Valuation Results

The user acknowledges and agrees that:

Valuation results are based on the information, images, and data provided by the user.

The estimated value is indicative and approximate only.

The actual market value, selling price, or purchase price may differ from the valuation provided in the report.

The valuation report does not constitute an offer to sell or purchase and does not guarantee any current or future market value.

Each valuation certificate or report has a specific issuance date and validity period. The value of an asset may change over time due to usage, depreciation, market conditions, or other factors.

5. Disclaimer of Liability

The user expressly agrees that:

The application serves solely as a technology platform providing valuation services and is not a party to any sale, purchase, negotiation, or transaction resulting from the valuation.

The application does not guarantee the accuracy, completeness, or suitability of any valuation report for commercial, financial, investment, legal, or financing purposes.

The application shall not be liable for any financial, commercial, investment, legal, or other losses arising from reliance on valuation results.

The application shall not be responsible for any decisions made by the user based on the reports or information provided.

The valuation service does not replace professional technical, engineering, legal, or real estate inspections or assessments.

The user is solely responsible for verifying information and making independent decisions before engaging in any sale, purchase, investment, or other transaction.

6. Intellectual Property Rights

All rights related to the application, including but not limited to designs, logos, trademarks, software, databases, content, text, and images, are owned by Thaman or its licensors. Such materials may not be copied, reproduced, distributed, modified, or used without prior written consent.

7. Account Suspension and Termination

The application reserves the right to suspend, restrict, or terminate any user account in the following cases:

Violation of these Terms and Conditions.

Submission of false, inaccurate, or misleading information.

Misuse of the application or its services.

Engagement in any unlawful activity or conduct that may harm the application, its users, or its reputation.

8. Amendments to the Terms and Conditions

Thaman reserves the right to modify, update, or amend these Terms and Conditions at any time. Updated versions will be published through the application, and continued use of the application after such publication constitutes acceptance of the revised terms.

9. Governing Law and Jurisdiction

These Terms and Conditions shall be governed by and construed in accordance with the laws and regulations of the Kingdom of Saudi Arabia. Any dispute arising out of or relating to the use of the application shall be subject to the exclusive jurisdiction of the competent courts of the Kingdom of Saudi Arabia.

10. Future Services

The application may introduce additional features and services that are currently under development and review, including but not limited to Thaman Marketplace and other related services. Such services may be launched in the future and may be subject to additional terms and conditions upon their release.
